BetMGM Faces Massachusetts Hearing After Emails Sent to 3,803 Underage People

The Massachusetts Gaming Commission (MGC) is investigating how 3,803 people under the state’s legal sports betting age of 21 received marketing emails from BetMGM. There were also 19 people who had voluntarily excluded themselves who got emails, and 25 individuals who were in a cool-off period at the time.

The date of birth of 37,632 of the 96,167 people who received emails couldn’t be determined. The emails were sent to users of the MLB Ballpark App during Red Sox games between April 2024 and July 2025.

BetMGM attributed it to an employee who failed to follow internal promotion protocols.

The MGC revealed during its February 12 meeting that it will hold a formal adjudicatory hearing for BetMGM regarding the issue. BetMGM attributed it to an employee who failed to follow internal promotion protocols.

Talking about the matter, MGC Commissioner Eileen O’Brien highlighted the sizable nature of the problem, emphasizing that the “percentage of those emails where they cannot affirmatively say we’re over 21 is really disturbing.”

Commissioner Nakisha Skinner echoed these sentiments, saying that three distinct vulnerable groups were affected by BetMGM’s email campaign.

At the adjudicatory hearing, for which a date hasn’t been set, the regulators will present evidence and BetMGM can provide a defense. The MGC can question witnesses and ultimately decide on any action, which could include a fine, new compliance requirements, and even restricted licenses.
