Couple Sues Resorts World Las Vegas Hotel Over Black Mold Exposure

Most people who travel to some extent have at least one hotel horror story. I haven’t had anything too terrible happen, but I have certainly had a couple of occasions where I have had to request a new room. One involved a cockroach and one involved something that’s probably not fit to print. But everything worked out just fine.

Unfortunately for a Georgia couple, their stay at Resorts World Las Vegas was allegedly ruined by something they were unable to see before things got bad: black mold.

As reported by the Las Vegas Review-Journal, Mark and Leilani Nickerson filed a lawsuit on June 2 against Conrad Las Vegas at Resorts World, one of the three Hilton Hotels on the property, claiming negligence because of black mold in their room during their January stay.

While it does not sound like they saw the mold while in the room, the couple said their symptoms corresponded to mold exposure. Both had flu-like symptoms, headaches, and “irritation.” Mark also developed a full-body rash.

The Nickersons might not have thought their maladies resulted from mold had they not walked by their original room after being moved to a different room on the same floor. When they passed their old room, they could see inside because the door was open, fan running in an attempt to dry out a wet carpet, which had been pulled back to reveal black mold “all over the place.”

The maintenance person working on the room told them that there was definitely mold and water in there and that “it happens a lot due to the way the showers were constructed/designed.”

The hotel gave the Nickersons a small discount on their bill, but less than they requested, and even asked them to sign a waiver to prevent a lawsuit.

The couple is suing for medical costs, lost income from their illnesses, and punitive damages.
