Taking a Chance on Monopoly

The 1994 Lotteries Act and the 1999 Casinos Act provide the legislation that names Svenska Spel as the only licensed operator in our country. The law states that it is illegal to promote unlicensed gambling services in Sweden. The wording of this was updated in 2002 to include online gambling. The government’s justification for this has traditionally been that by controlling gambling in the country it protects society from its ill effects. They also claim it prevents money laundering and other illegal activities.

In 2007 the EU formally demanded that Sweden, along with other nations such as Hungary and Greece, open their gambling markets to competition in the interests of free movement of services. While other countries amended their laws accordingly, our government has repeatedly refused to make the necessary changes. There have been instances where change had appeared to be on the horizon – in March 2014 Sweden asked the Commission for more time before legal action was taken as changes were imminent.

The changes were not forthcoming though, and by October 2014 the EU had referred the case to the European Court of Justice. The case involved two counts of failing to change its laws, firstly relating to online betting and secondly, online poker games. The story took another twist in early 2015, when the Minister for Public Administration, Ardalan Shekarabi, said that Sweden has no plans to break the Svenska Spel monopoly, and opening up the gambling market is not on the government’s agenda.
